User Agreement

1. Introduction

This User Agreement ("Agreement") is a contract between you and Hikari Nova that governs your use of the Hikari Nova trading platform and related services. This Agreement should be read in conjunction with our Terms of Service, Privacy Policy, and Risk Disclosure.

By creating an account and using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, you may not access or use our services.

2. Account Registration

To use our trading platform, you must create an account. During the registration process, you will be required to provide certain information, including but not limited to:

  • Full legal name
  • Email address
  • Date of birth
  • Residential address
  • Phone number
  • Government-issued identification
  • Tax identification number

You represent and warrant that all information provided during the registration process is accurate, complete, and current. You agree to update your information promptly if any changes occur.

We reserve the right to verify your identity at any time. We may use third-party service providers to verify the information you provide and to obtain additional information about you as required by applicable laws and regulations.

3. Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to:

  • Create a strong, unique password for your account
  • Enable two-factor authentication when available
  • Not share your account credentials with any third party
  • Notify us immediately of any unauthorized use of your account or any other security breach
  • Ensure that you log out from your account at the end of each session

You are solely responsible for all activities that occur under your account. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. Trading Activities

When using our trading platform, you agree to:

  • Comply with all applicable laws, regulations, and rules governing trading activities
  • Not engage in any form of market manipulation, fraud, or deceptive practice
  • Not use any automated software, algorithm, or fraud, or deceptive practice
  • Not use any automated software, algorithm, or bot to interact with our platform without our express written permission
  • Not exploit any technical vulnerabilities in our platform
  • Accept the risks associated with trading financial instruments

We reserve the right to monitor your trading activities and to take appropriate action if we detect any suspicious or prohibited behavior. This may include suspending or terminating your account, reversing transactions, or reporting your activities to relevant authorities.

5. Fees and Charges

You agree to pay all applicable fees and charges associated with your use of our trading platform. These may include:

  • Trading fees (e.g., maker and taker fees)
  • Deposit and withdrawal fees
  • Currency conversion fees
  • Inactivity fees
  • Account maintenance fees

Our current fee schedule is available on our website. We reserve the right to modify our fees at any time by providing notice through our platform or by email. Your continued use of our services after such notification constitutes your acceptance of the modified fees.

6. Deposits and Withdrawals

You may deposit funds into your account using the payment methods we support. All deposits must come from accounts or payment methods in your name. We do not accept third-party deposits.

You may request withdrawals from your available balance at any time. Withdrawal requests are subject to:

  • Completion of all required identity verification procedures
  • Availability of the requested withdrawal method
  • Minimum and maximum withdrawal limits
  • Processing times, which may vary depending on the withdrawal method
  • Applicable fees

We reserve the right to delay or refuse withdrawals if we have reason to believe that the request is fraudulent, violates applicable laws or regulations, or if there are outstanding obligations on your account.

7. Dispute Resolution

If you have a dispute regarding any aspect of our services, you agree to first attempt to resolve the dispute by contacting our customer support team. If our customer support team is unable to resolve your dispute to your satisfaction, you may escalate the matter through our formal dispute resolution process.

All disputes shall be resolved in accordance with the following procedure:

  1. Submit a detailed written complaint to our compliance department
  2. Our compliance department will acknowledge receipt of your complaint within 3 business days
  3. We will investigate your complaint and provide a response within 15 business days
  4. If you are not satisfied with our response, you may request that the matter be escalated to senior management
  5. If the dispute remains unresolved, it shall be settled through arbitration in accordance with the rules specified in our Terms of Service

8. Account Termination

You may terminate your account at any time by submitting a request to our customer support team. Before closing your account, you must withdraw all available funds.

We may terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of this Agreement or any other policies
  • Suspected fraudulent or illegal activity
  • Regulatory requirements
  • Extended period of inactivity
  • Risk management considerations

Upon termination, you will no longer have access to your account, and any pending transactions may be canceled. Termination does not relieve you of any obligations incurred prior to termination.

9. Amendments

We reserve the right to amend this Agreement at any time. We will notify you of any material changes through our platform or by email. Your continued use of our services after such notification constitutes your acceptance of the amended Agreement.

If you do not agree with the amended Agreement, you must stop using our services and close your account.
